Fire Check Scotland is a trading name of Archibald Marckay Limited ("the Company"), part of the Archibald Marckay Group.
References within these Terms & Conditions to "Fire Check Scotland", "we", "our" or "us" refer to Archibald Marckay Limited.
1. Acceptance of Terms
By instructing Fire Check Scotland to provide services, you agree to be bound by these Terms & Conditions.
2. Services
Fire Check Scotland provides professional fire safety consultancy services including, but not limited to:
- Fire Risk Assessments
- Fire Door Inspections
- Fire Safety Compliance Reviews
- Fire Safety Consultancy
Services are carried out by suitably trained and qualified assessors and are based upon information available and conditions observed at the time of inspection.
3. Client Responsibilities
The Client agrees to:
- Provide safe and unrestricted access to all relevant areas of the property.
- Provide accurate and complete information regarding the premises.
- Inform us of any known fire safety concerns or restrictions.
- Ensure a suitable representative is available where required.
Where access is restricted or information is unavailable, the scope and accuracy of the assessment may be affected.
4. Inspections and Reports
Reports are prepared based on observations made during the inspection and information supplied by the Client.
Reports represent our professional opinion at the date of inspection and should not be interpreted as a guarantee of compliance or assurance that a fire incident cannot occur.
Fire Check Scotland accepts no responsibility for changes to the property, occupancy, use, condition, legislation or guidance following the inspection date.
5. Recommendations
Recommendations contained within our reports are intended to assist the Client in managing fire safety risks.
The Client remains responsible for implementing recommendations and maintaining compliance with all applicable legislation and regulations.
6. 24-Hour Report Turnaround
Where advertised, Fire Check Scotland aims to provide completed reports within 24 hours of the inspection being completed.
This applies only where:
- Full access to the property has been provided.
- All necessary information has been supplied.
- No further investigations are required.
The turnaround period may be extended where information is incomplete or circumstances arise outside our reasonable control.
7. Fees and Payment
All fees are quoted exclusive of VAT unless otherwise stated.
Invoices are issued following completion of the inspection.
Payment is due immediately upon receipt of invoice.
Reports and supporting documentation will not be released until payment has been received in full.
We reserve the right to charge interest and recovery costs on overdue accounts where permitted by law.
8. Cancellations
Appointments cancelled more than 48 hours before the scheduled inspection may be rearranged without charge.
Appointments cancelled within 48 hours may incur a cancellation charge of up to 50% of the agreed fee.
Appointments cancelled on the day of attendance, or where access is unavailable, may be charged in full.
9. Limitation of Liability
Fire Check Scotland maintains appropriate Professional Indemnity and Public Liability Insurance.
Our liability arising from any service shall be limited to the value of the fees paid for that service.
Nothing within these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded.
10. Intellectual Property
All reports, documents and materials produced by Fire Check Scotland remain our intellectual property until paid for in full.
Reports are prepared solely for the use of the Client and may not be copied, altered, reproduced or relied upon by third parties without our prior written consent.
11. Confidentiality
Both parties agree to keep confidential any commercially sensitive information obtained during the provision of services.
12. Complaints
Any complaint regarding our services should be submitted in writing within 30 days of the service being provided.
Complaints will be investigated in accordance with our Complaints Procedure.
13. Governing Law
These Terms & Conditions are governed by the laws of Scotland.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Scottish Courts.
